Application of law in resolving intellectual property rights disputes in Vietnam: Current practice, obstacles, and recommendations

Abstract
This study analyzes the application of law in resolving intellectual property rights disputes in Vietnam amid digitalization and the increasing value of intellectual assets. Based on legal and practical analysis, it evaluates negotiation, mediation, commercial arbitration, and court litigation as dispute resolution mechanisms. The study also identifies difficulties relating to electronic evidence, expert assessment, proof of damages, resolution time, and judicial specialization. On this basis, the study proposes improving legal guidance, enhancing the effectiveness of Intellectual Property Courts, and promoting alternative dispute resolution mechanisms in the digital environment.
