The nature of partnership does not Change when the law on enterprises stipulates that a partnership company has its own legal status

To encourage the development of partnership companies in Vietnam, the Law on Enterprises in 2005, 2014, and 2020 made new breakthroughs in terms of the subject status of partnerships, allowing a partnership company to have its legal status since its business registration date. So does this regulation change the nature of partnerships when a partnership company is established and operated in Vietnam? This paper analyzes (i) the characteristics of partnerships and (ii) whether the nature of a partnership company changes or not when the Law on Enterprises stipulates that a partnership company has its own legal status. This paper is expected to promote the development of partnership companies in Vietnam.
