Improving the legal framework for digital assets to meet the development needs of the crypto asset market in Vietnam

This study examines the theoretical foundations and current legal framework concerning digital assets, crypto-assets, property rights, and related transactions based on the 2015 Civil Code, the Law on Electronic Transactions No. 20/2023/QH15, and, in particular, the Law on Digital Technology Industry No. 71/2025/QH15, which took effect on January 1, 2026, and establishes a legal framework for digital assets and crypto-assets. The study also examines the pilot operation of the crypto-asset market under Resolution No. 05/2025/NQ-CP of the Government. The findings indicate that Vietnam has made significant progress in legally recognizing and regulating digital assets; however, further improvements are needed regarding ownership rights, transactions, investor protection, anti-money laundering, dispute resolution, and enforcement. The study therefore proposes directions for improving the legal framework to ensure transparency, transaction security, and the sustainable development of the crypto-asset market in Vietnam.
