Compliance with International Humanitarian Law and International Human Rights Law in Technology Enterprises: Recommendations for Vietnam

Abstract

Resolutions No. 57-NQ/TW and No. 68-NQ/TW of the Politburo set out orientations to promote the overseas investment expansion of Vietnamese digital technology enterprises. However, the increasingly complex international political situation and the rise in armed conflicts create an urgent requirement to ensure compliance with international humanitarian law and international human rights law in cross-border business activities. This article analyzes the due diligence requirements in cooperation and investment activities involving conflict-affected areas or actors, while comparing them with a number of recommendations by international organizations. On that basis, the article proposes several recommendations to support Vietnamese digital technology enterprises in strengthening their compliance with international humanitarian law and international human rights law when expanding their operations overseas.
