Statute of limitations for filing lawsuits in civil cases involving the review of administrative decisions and recommendations for legal reform

Article 34 of the 2015 Civil Procedure Code allows courts to review the legality of individual administrative decisions when such review is necessary for resolving a civil case. However, current law does not clearly determine whether this mechanism is subject to the statute of limitations applicable to administrative lawsuits, resulting in inconsistent interpretations and judicial practice. By analyzing the legal nature of Article 34 and its relationship with administrative procedural law, this study identifies regulatory gaps and examines their implications for litigants’ access to justice. The study argues that reviewing an administrative decision within a civil case is not equivalent to initiating an administrative lawsuit. It therefore proposes directions for legal reform to clarify the applicable limitation rules, promote consistent adjudication, and better protect litigants’ right of access to justice.
