Some theoretical issues concerning the concept of future-formed housing

Abstract
This study examines theoretical issues concerning future-formed assets and future-formed housing under Vietnamese law. By clarifying the legal nature of future-formed assets, the study compares the approaches adopted by the 2015 Civil Code, the 2023 Law on Housing, and the 2023 Law on Real Estate Business in identifying future-formed housing. The findings reveal inconsistencies among these legal provisions, which create difficulties in determining the regulated subject matter and applying the law in practice. The study proposes directions for legal reform to improve the consistency and coherence of the legal system and strengthen the protection of homebuyers’ lawful rights and interests.
