Legal challenges in using digital assets as collateral in credit transactions in Vietnam

Abstract
This study examines key legal issues arising from the use of digital assets as collateral in credit activities in Vietnam. Although digital assets have been initially recognized within the legal system, critical aspects remain insufficiently defined, including their legal status, mechanisms for the establishment and protection of rights, the scope of their use as collateral, appropriate forms of security interests, third-party enforceability, and procedures for asset realization in cases of default. The analysis highlights significant ambiguities and gaps in the current regulatory framework, underscoring the challenges these pose for integrating digital assets into secured lending practices within the evolving digital economy.
