Some problems during the settlement of agricultural land use rights disputes at the two-level people's court of Cao Bang province

Land disputes in general and agricultural land use rights disputes in particular are always a major concern of public interest, especially in specialized agricultural production areas. The settlement of land disputes via courts is the last method for parties when their conflicts or disagreements cannot be resolved or conciliated by other agencies. However, some problems cannot be avoided during the land disputes settlement process of the court. This paper analyzes some limitations and problems in the court’s settlement of agricultural land use rights disputes based on the practice in Cao Bang province, a northern mountainous border province of Vietnam. Based on the paper’s findings, some recommendations are made in order to improve the law and solutions are proposed to improve the effectiveness of the settlement of agricultural land use rights disputes at the two-level People's Court of Cao Bang province.
