The issue of identifying and providing foreign laws when adjudicating civil cases with foreign elements in Vietnam

Abstract
Judicial practice and international private law in many countries, including Vietnam, when regulating for the choice of applying foreign laws to the settlement of disputes, all acknowledge the burden of proof of the involved parties and also the Court. Although there are still barriers of trial precedent; capacity and experience to settle this type of dispute, but the current Vietnamese civil procedure code 2015 has initially added relevant provisions fulfill the requirements of the international integration in the judicial activities.
