Some legal issues about electronic notarization

As Vietnam is rapidly shifting towards a digital economy, it is necessary to apply the latest advancements in information technology in different fields including notarization in general and electronic notarization in particular. However, the enforcement of the Law on Notary shows that the development of electronic notarization still faces many challenges. This is because the legal framework on electronic notarization is newly formed, hence it is difficult to cover all issues arising from practice. This study is to provide an overview on electronic notarization, clarify the nature of electronic notarization, and analyze the main obstacles for the implementation of electronic notarization. Based on the study’s analysis, some recommendations are made to improve the legal framework on electronic notarization and enhance the effectiveness of regulations on electronic notarization in Vietnam.
