Abstract
This study highlights the Theory of State and Law as a foundational discipline that plays a crucial role in shaping the legal system. Through an analysis of key theoretical components, including concepts, scope, methods, origins, nature, functions, and roles of the State and law, the study connects these foundations to the practical process of building a socialist rule-of-law state in Vietnam from 1945 to the present. The study further clarifies Vietnam’s achievements and ongoing challenges in legislation, executive governance, judicial reform, and human rights protection. Based on these insights, the study proposes several recommendations to enhance theoretical frameworks and institutional development in the context of digital transformation and globalization.
