Tùy thuộc vào quan niệm truyền thống và văn hóa pháp lý, luật các nước tiếp cận vấn đề mang thai hộ ở các góc độ khác nhau: có quốc gia cấm hoàn toàn việc mang thai hộ; có quốc gia chỉ cho phép mang thai hộ vì mục đích nhân đạo; có quốc gia chấp nhận mang thai hộ cả vì mục đích thương mại. Để có cái nhìn khách quan về việc mang thai hộ, bài viết sẽ lần lượt phân tích cả ba quan điểm này.
