Bài viết tập trung phân tích vai trò của tập quán trong mối tương quan với các truyền thống pháp lý chủ yếu trên thế giới, bao gồm hệ thống Common law, Civil law và hệ thống pháp luật hỗn hợp, qua đó làm rõ cơ sở lý luận cho việc thừa nhận và áp dụng tập quán trong lĩnh vực hôn nhân và gia đình. Trên cơ sở đó, nghiên cứu thực tiễn áp dụng tập quán trong giải quyết các vụ việc hôn nhân và gia đình tại một số quốc gia tiêu biểu, từ đó rút ra những kinh nghiệm có giá trị tham khảo, gợi mở nhằm hoàn thiện cơ chế pháp lý về áp dụng tập quán trong giải quyết các vụ việc hôn nhân và gia đình ở Việt Nam trong bối cảnh hiện nay.
